Indian River County Files Appeal of Lawsuit Against Virgin Trains Over Tax-Free Bonds

INDIAN RIVER COUNTY — The county officially filed its appeal of a federal judge’s ruling concerning Virgin Trains USA’s sale of tax-free bonds.

The appellate brief against Virgin Trains, formerly Brightline, was filed Wednesday in the U.S. Court of Appeals. The county claims the Virgin Trains passenger train service project is ineligible for tax-free bonds, County Attorney Dylan Reingold said in an email.

In 2018, Virgin Trains began passenger train service between West Palm Beach and Miami. It plans to begin construction on its extension soon, and is hoping to be ready for passenger service to Orlando International Airport in 2021.
